  • 什么情况可认定工伤?

 职工有下列情形之一的,应当认定为工伤:
 
  (1)、在工作时间和工作场所内,因工作原因受到事故伤害的;
 
  (2)、工作时间前后在工作场所内,从事与工作有关的预备性或者收尾性工作受到事故伤害的;
 
  (3)、在工作时间和工作场所内,因履行工作职责受到暴力等意外伤害的;
 
  (4)、患职业病的;
 
  (5)、因工外出期间,由于工作原因受到伤害或者发生事故下落不明的;
 
  (6)、在上下班途中,受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的;(7)法律、行政法规规定应当认定为工伤的其他情形。
 
  职工有下列情形之一的,视同工伤:
 
  (1)、在工作时间和工作岗位,突发疾病死亡或者在48小时之内经抢救无效死亡的;
 
  (2)、在抢险救灾等维护国家利益、公共利益活动中受到伤害的;
 
  (3)、职工原在军队服役,因战、因公负伤致残,已取得革命伤残军人证,到用人单位后旧伤复发的。
 
  职工有前款第(1)项、第(2)项情形的,按照本条例的有关规定享受工伤保险待遇;职工有前款第(3)项情形的,按照工
 
  伤条例的有关规定享受除一次性伤残补助金以外的工伤保险待遇。
Employees who have one of the following circumstances shall be recognized as industrial injury:
 
 
 
(1) injuries caused by accidents during working hours or at the workplace;
 
 
 
(2) injuries caused by accidents while engaged in work-related preparatory or finishing work in the workplace before and after working hours;
 
 
 
(3) being injured by violence or other accidents during working hours or in the workplace;
 
 
 
(4) suffering from occupational diseases;
 
 
 
(5) he/she is injured or missing due to an accident during his/her absence from work;
 
 
 
(6) being injured by a traffic accident or an urban rail transit, passenger ferry or train accident that is not his/her main responsibility during commuting; (7) other circumstances that shall be recognized as work-related injuries as stipulated by laws and administrative regulations.
 
 
 
The worker has one of the following circumstances, regarded as industrial injury:
 
 
 
(1) death from sudden illness during working hours or at the working post, or death within 48 hours after failure of rescue;
 
 
 
(2) injured in activities to safeguard national and public interests, such as rescue and disaster relief;
 
 
 
(3) a worker who was originally serving in the army, was injured or disabled due to war or duty, has obtained a revolutionary disabled military personnel certificate, and his or her old injury recurred to the employing unit.
 
 
 
Employees who are under the circumstances of items (1) and (2) of the preceding paragraph shall enjoy the benefits of industrial injury insurance in accordance with the relevant provisions of these regulations. An employee who falls under item (3) of the preceding paragraph shall be regarded as a worker
 
 
 
The relevant regulation of injury byelain enjoys the inductrial injury insurance treatment beyond one-time disable grant-in-aid.
